a basic overview
of probate in texas

When a person passes away, the property that they own will be transferred to another party. Probate is the legal process through which a Texas court recognizes a person’s passing and, subsequently, oversees the identification and distribution of their property and assets. Property and assets can be divided into two basic categories: probate and non-probate.

Assets that are covered by a trust or joint ownership with a right of survivorship can avoid probate. That being said other types of property, including all of the assets covered by a person’s will, must go through the probate process. Our experienced lawyers will assist you in all aspects of the legal process. We will walk you through probate—ensuring that your legal rights and financial interests are fully protected.

probate with a will

in Texas

How exactly the probate process proceeds depends on a number of different factors, including whether or not the decedent had a will. If there is a will, that legal document must be confirmed as valid. From there, an executor will be appointed to carry out the specific instructions contained within the will.

The executor of a has many responsibilities—from notifying all of the creditors of the decedent’s passing to identifying and gathering all of the assets and property that are covered by the will. Once the court has approved the executor’s inventory, they can begin paying off the debts and distributing the property to the decedent’s selected beneficiaries.

To be clear, the probate process is not always a complicated one. While navigating it can feel daunting, our attorneys who serve you in New Braunfels are here to walk with you through every step.

probate without a will

in Texas

In Texas, a person’s estate still goes through probate even if they passed away without a valid will in place. Of course, the lack of a will can make the process far more complicated. If your loved one died without a will, our probate lawyers from our San Antonio office can help you navigate the process. You are not alone.

As a general matter, our attorneys typically start the process by reviewing the family and marital history of the decedent. To be clear, when there is no will, a person no longer gets any direct say into what will happen to their assets and property. Instead, the property will be distributed in accordance with Texas state law.

Our law firm can file an Application to Determine Heirship and an Application for Letters of Administration on your behalf. By doing so, we can move the process forward and help you initiate a claim to get access to the assets that are rightfully yours under Texas law. As intestacy cases are more complicated, it is crucial that you seek guidance and support from an experienced attorney as early on in the process as possible.
